Adult Game Alerts. How to make them legally correct?

Hello. I'm developing a game for adults and I was wondering if the method of warning the adult game I'm using is correct or if I'm wrong.
Before accessing the game, two images are shown:
one of attention in red text, adult content and then that people, situations, historical events are purely random etc etc.
Before actually entering the game, a question is asked: are you of age: yes or no.
I ask myself these questions because things can change over time or I can have a wrong perception.
Are the images of pegi 18 covered by copyrights?

A warning you need to accept for being of adult age is enough yes, that's the bare minimum other adult platforms also use.

Asking for legal advice isn't really something that someone should do on a adult/porn game related forum; especially when there's a clear language issue. Not only the answer you'll get will not necessarily be legally correct, or apply to the Law in your country, but it's also possible for some important information to be lost in translation.

This being said, warn about the content, offer a way to goes out if the player is bellow legal age, and you should be good. At least as long as the legal vector you use to distribute your game also enforce the fact that people must be of legal age to download it. What mean, by example, that if you have your own website, where people can download the game, or a demo of the game, it must follow the minor protection laws in your country.


Are the images of pegi 18 covered by copyrights?
I don't know if they are copyrighted or not, but I'm relatively sure that one can't use them without an actual rating from PEGI.
They are official icons stating that your game have past through a rigorous reviewing process performed by a legal entity. Using them without your game having been actually reviewed by PEGI is forgery; you pretend to have a legal agreement that you don't have.

Now, most of the time PEGI itself will do nothing against you, at most they'll ask you to remove the icons; you're warning about the content, using a way understood by the public, it's a good thing. But legally it still engage your responsibility, what can be an issue.
